About these terms
In these terms, “NULI”, “we”, “us” and “our” refer to the Australian business trading as NULI. “You” means the person using this website or placing an order. If you have questions before purchasing, contact hello@nulisleep.com.au.
We may update these terms from time to time. The version in force when you place an order will apply to that order.
Products and information
We take reasonable care to present product descriptions, colours, measurements and photographs accurately. Screen settings, lighting and the natural character of fibres may cause slight variations. These variations do not limit your rights where goods fail to match their description or a consumer guarantee.
Prices and payment
Prices are shown in Australian dollars (AUD) and include GST where applicable. Any delivery charge will be displayed before you confirm your order. Payment must be authorised by the payment provider at checkout.
We may correct an obvious pricing or description error before accepting an order. If payment has already been taken and we cannot fulfil the order on the stated terms, we will contact you and provide a refund.
Orders and availability
Your order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched. Products are subject to availability and purchase limits may apply.
We may decline or cancel an order for reasonable grounds, including suspected fraud, unauthorised payment, an obvious error or lack of stock. If we cancel after taking payment, we will refund the amount paid.
Shipping, title and risk
Shipping is governed by our Shipping Policy. Ownership and risk pass to you when the order is delivered to the address you supplied, subject to your rights under the Australian Consumer Law.
Returns and consumer guarantees
Our Returns & Refunds Policy forms part of these terms. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded.
Website use and intellectual property
You may use this website for personal, lawful shopping and information purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape it at scale or use its content commercially without permission.
Unless otherwise stated, the NULI name, branding, copy, photographs, graphics and site design are owned by or licensed to NULI and are protected by applicable intellectual property laws.
Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website. This limitation does not apply where liability cannot legally be excluded, including liability arising under the Australian Consumer Law.
Governing law
These terms are governed by the laws applicable in Australia. You and NULI submit to the courts and tribunals that have jurisdiction over any dispute, without limiting any rights you have to bring a claim in your state or territory.
